These Terms of Service ("Terms") govern your use of buffyprotein.com (the "Site"), your purchases from us, and our email and text message programs (together, the "Services"), all offered by Em & Audrey Enterprises Inc., a Delaware corporation doing business as Buffy Protein ("Buffy," "we," "us," or "our"). By using the Services or placing an order, you agree to these Terms and to our Privacy Policy and Refund Policy, which are part of these Terms. If you do not agree, please do not use the Services.

Eligibility and Accounts

You must be at least 18, or the age of majority where you live, to place an order or create an account. If you create an account, keep your login details secure and your information accurate. You are responsible for activity under your account, and you should tell us right away if you think someone has used it without permission.

Changes to These Terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date above. Changes apply from the date they are posted and do not affect orders placed before then. Continuing to use the Services after a change means you accept the updated Terms.

Products

We sell Buffy protein dips and Buffy apparel and merchandise. We try to describe and show our products accurately, but colors, packaging, and product photos may vary slightly from what you receive. Products, flavors, and quantities are subject to availability, and we may limit quantities per customer or decline orders that appear to be for resale.

Food Safety, Allergens, and Nutrition

Buffy dips are perishable food products made with meat. Please:

  • Check the label. The ingredient, allergen, and nutrition information printed on the package you receive is the most accurate and current source. Always read it before eating, especially if you have a food allergy or dietary restriction.
  • Store and handle it properly. Refrigerate promptly on arrival and follow the storage, handling, and "use by" instructions on the package. Do not eat product that arrives warm, damaged, or past its date; contact us instead.
  • Use your judgment. Nutrition and protein content on the Site is general information, not medical or dietary advice. Talk to a healthcare provider about your own diet and health needs.

Prices and Pre-Orders

Prices are in US dollars and do not include taxes or shipping unless stated. Prices and promotions may change at any time, but changes do not affect orders already accepted. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund you, even after confirmation.

Some products may be offered for pre-order. We will show an estimated ship date at the time of purchase. If we cannot ship by that date, we will tell you and give you the choice to cancel for a full refund.

Orders and Payment

Your order is an offer to buy. We accept it when we ship it or send a shipping confirmation. We may refuse or cancel any order, for example because of stock limits, pricing errors, or suspected fraud; if we cancel after charging you, we will refund you in full. You agree to give accurate billing and shipping information and to pay all charges at checkout, including taxes and shipping. Payments are handled by our payment processors, and we do not store your full card number.

Shipping

We ship within the United States only. Because our dips are perishable, they ship in insulated packaging and may only ship on certain days so they do not sit in transit over a weekend. Delivery dates are estimates. Title and risk of loss pass to you when the carrier delivers your order. Please bring perishable packages inside and refrigerate them as soon as they arrive.

Returns and Refunds

Returns, refunds, and damaged or incorrect orders are covered by our Refund Policy. For food safety reasons, we cannot accept returns of food products. If your order arrives damaged, warm, or incorrect, contact us at contact@buffyprotein.com with your order number and photos, and we will make it right.

Text Messaging (SMS) Terms

By opting in to the Buffy Protein text program, you agree to receive recurring automated marketing and informational text messages from Buffy Protein at the mobile number you provide, such as product launches, restock alerts, promotions, and order updates.

  • Consent is optional. Consent is not a condition of any purchase.
  • Frequency and cost. Message frequency varies. Message and data rates may apply.
  • Opting out. Reply STOP to cancel at any time. You may also opt out by any other reasonable means, such as replying "cancel," "end," or "unsubscribe," or by emailing contact@buffyprotein.com. You will receive one message confirming your opt-out and no further marketing texts. To rejoin, sign up again the way you first opted in.
  • Help. Reply HELP for help or email contact@buffyprotein.com.
  • Carriers. Carriers are not liable for delayed or undelivered messages.
  • Your number. You confirm you are the subscriber or authorized user of the mobile number you provide. If you change or give up that number, please opt out first.
  • Privacy. We will not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

Reviews and Submissions

If you post a review, photo, or comment, or send us ideas or feedback, you give us a free, worldwide, non-exclusive license to use, copy, display, and share it in connection with Buffy, including in marketing. You confirm that your content is honest, reflects your own experience, is yours to share, and does not violate anyone's rights. We may remove content that is unlawful, offensive, misleading, or violates these Terms. We do not pay for, edit, or suppress reviews based on whether they are positive or negative.

Intellectual Property

The Site and its content, including the Buffy Protein name, Dip Drip, logos, product names, designs, photos, and text, belong to us or our licensors and are protected by trademark, copyright, and other laws. You may not copy, sell, or use them without our written permission, except to view and share the Site for personal, non-commercial purposes.

Acceptable Use

You agree not to use the Services to:

  • break any law or violate anyone's rights;
  • submit false information or impersonate anyone;
  • buy products for unauthorized resale;
  • upload viruses or malicious code, or interfere with the Site's security or operation;
  • scrape, crawl, or collect data from the Site, or collect other users' personal information;
  • harass, abuse, or harm others.

We may suspend or end your access to the Services if you violate these Terms.

The Site may link to or use third-party websites and tools, such as Shopify, payment processors, and social media platforms. We are not responsible for their content, products, or practices, and your use of them is governed by their own terms.

Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. Some states do not allow these exclusions, so they may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, BUFFY AND ITS OWNERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM THE SERVICES OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCTS GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or under applicable food safety and consumer protection laws.

Indemnification

You agree to defend and hold harmless Buffy and its owners, employees, and agents from third-party claims, losses, and reasonable legal fees arising from your breach of these Terms, your misuse of the Services, or content you submit.

Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. If you have a concern, please email us first at contact@buffyprotein.com so we can try to resolve it informally. Any dispute not resolved informally will be handled in the state or federal courts located in Kings County, New York, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court where eligible. This section does not take away any rights you have under the consumer protection laws of the state where you live.

General

  • Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us about the Services.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. Our not enforcing a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example in a sale of the business.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as weather, carrier delays, or supply shortages.
